Terms of Service

TokenByte is an AI API gateway that provides access to multiple third-party AI model providers through a unified interface. We act as an intermediary between you and upstream AI providers and do not directly provide AI model capabilities.

You must register an account to use the Service. You agree to:

• Provide truthful and accurate registration information
• Keep your account credentials and API keys secure
• Be responsible for all activity under your account
• Be at least 18 years old or the age of majority in your jurisdiction

We reserve the right to suspend or terminate accounts for policy violations.

When using the Service, you must not:

• Violate any applicable laws or regulations
• Infringe on the intellectual property or other legal rights of others
• Generate or distribute illegal, harmful, threatening, abusive, or otherwise objectionable content
• Attempt unauthorized access to any part of the Service
• Reverse-engineer, decompile, or disassemble the Service
• Resell or redistribute API access without explicit authorization
• Send automated requests that interfere with or degrade Service performance
• Circumvent rate limits or other technical restrictions

The Service is billed on a pay-as-you-go basis, including per-token and per-request billing modes. Specific prices are published on the Service platform.

• Charges are calculated in real time based on actual usage
• API requests will be rejected when your account balance is insufficient
• Incurred charges are non-refundable unless otherwise required by law
• We reserve the right to adjust pricing with advance notice

We strive to provide stable and reliable service but do not guarantee uninterrupted or error-free operation. Service availability may be affected by:

• Upstream AI provider availability and performance
• Scheduled maintenance (with advance notice)
• Force majeure events

We provide automatic failover to minimize downtime impact but are not liable for losses caused by service interruptions.

The intellectual property of the Service itself (including software, design, trademarks, and documentation) belongs to TokenByte. Rights to content generated through the API are governed by the respective upstream provider’s terms.

You retain all rights to input data transmitted through the Service.

The Service is provided on an “as is” and “as available” basis, without any warranties, express or implied, including but not limited to:

• Fitness for a particular purpose
• Accuracy of upstream AI model outputs
• Uninterrupted or vulnerability-free operation

TokenByte is not responsible for content generated by upstream AI providers.

To the maximum extent permitted by applicable law, TokenByte shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, data loss, or business interruption.

Our total liability shall not exceed the total fees paid by you in the 12 months preceding the claim.

We reserve the right to modify these Terms at any time. Significant changes will be communicated via email or in-service notification at least 30 days in advance. Continued use of the Service constitutes acceptance of the modified Terms.

If you do not agree to the modified Terms, you should stop using the Service and delete your account.
